Refugee Claims
Anyone who fears persecution when returning to a country of nationality or permanent residence is considered a refugee within the meaning of the Convention. They must clearly prove that their home country cannot provide sufficient public protection to protect them. Internationally recognized forms of fear of persecution include: Race, Religion, Belonging to a specific social group (sexual orientation / gender, etc.) Political Opinion, Nationality.
The Refugee Protection Division is the court of the Immigration and Refugee Commission. The Refugee Protection Agency accepts issues from those who claim the status of protected persons. Applications can be made at the IRCC or CBSA office in Canada, or at immigration locations such as airports and borders. If the claim is made at the place of entry, the original BOC form must be submitted to the Refugee Protection Agency within 15 days of submitting the application. When filing a complaint in Japan, the BOC form must be presented to the person in charge of the complaint. CBSA officers have alleged concerns about disapproval due to infringement of security, human rights or international rights, serious crimes or organized crime, or if officers are awaiting a court decision on the crime. The examination may be suspended. Plaintiffs allege that they have been sentenced to up to 10 years in prison. If the application turns out to be legal, the applicant may remain in Canada during the refugee application processing period.
