Who is Eligible?

As of January 22, 2025, IRCC has introduced new conditions for spouses of temporary foreign workers applying for an open work permit.

Your spouse may qualify if:

  1. You (the principal applicant) are working in Canada with a valid work permit
  2. You have at least 16 months of authorized work remaining
  3. You are employed in an eligible occupation under TEER 0, 1, 2, or 3 of the National Occupation Classification (NOC) 2021
  4. You and your spouse are in a genuine, ongoing relationship (married or common-law)

What is TEER 0, 1, 2, or 3?

To be eligible, your occupation must fall under one of the following levels:

  1. TEER 0: Management roles (e.g., restaurant manager, project manager)
  2. TEER 1: Professional jobs (e.g., engineers, IT specialists, doctors)
  3. TEER 2 & 3: Skilled trades and technical jobs (e.g., plumbers, electricians, supervisors)

 Spouses of workers in TEER 4 or 5 roles are no longer eligible as of 2025.

Documents Required

  1. Copy of principal applicant’s valid work permit
  2. Employer letter confirming NOC code and job duties
  3. Marriage certificate or common-law declaration
  4. Proof of ongoing cohabitation (if applicable)
  5. Passport, biometrics, and digital photo

  1. Government Fee: CAD $340 (includes open work permit + processing)
  2. Biometrics Fee: CAD $85 (if applicable)
